INTRODUCTION

The general Terms and Conditions (T&Cs) are governing the purchasing relations between the user of this site, hereinafter named “You”, and PRESTIGIOPLAZA.CO.ZA (ASBC SOUTH AFRICA (PTY) LTD), hereinafter named as “We”, “e-Shop” or “PRESTIGIOPLAZA.CO.ZA” – the company with headquarter situated at Unit 7 Gosforth Business Park, 22 Silverstone Road, Gosforth Park, Germiston, 2094, South Africa. These T&Cs aim into protecting your rights as valued customer as well as the rights of PRESTIGIOPLAZA.CO.ZA. By submitting your order, you come to binding contractual obligations with the e-Shop and accept the terms and conditions stipulated below.

ORDERING

On-line order processing consists of 4 easy steps. Once you have added the goods to “e-cart”, please click “Checkout” button and then:

  1. Login or register if new to the e-Shop
  2. Verify the billing information of your account
  3. Select or add new delivery address
  4. Verify and confirm the order
  5. Select payment method and complete the payment authorization

As a result, the purchasing part of the order is completed.

After receiving your order we will process it and send you a written confirmation of the acceptance of the order to the e-mail address you provided in your order form. The confirmation will include the following information:

  1. date of the order
  2. registration and contact details of e-shop
  3. details of the purchaser
  4. details of the ordered goods
  5. price of the ordered goods
  6. delivery charges
  7. total value of the order

Once the order confirmation is sent to you, the contract of delivery of the goods is considered concluded. At that time total amount of the ordered goods will be charged to your account.

GOODS AVAILABILITY

The availability of the goods is visible real time on www.prestigioplaza.co.za in item cards and tables with products.
Please select correct address of Delivery or login at the beginning of each shopping session in order to avoid any confusion. The final verification of the goods availability and delivery options to a certain country is done in step “Order Confirmation” during the order checkout process.
We reserve the right to cancel the contract between us if:

  1. we have insufficient stock to deliver the goods you have ordered;
  2. we do not deliver to your area; or
  3. one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.

PRODUCT INFORMATION

PRESTIGIOPLAZA.CO.ZA takes great care when putting information on-line with respect to the essential characteristics of our products, notably with respect to the technical descriptions emanating from our partners and suppliers and the photographs illustrating the products. However, PRESTIGIOPLAZA.CO.ZA does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.

SALES PRICES

The prices indicated on www.prestigioplaza.co.za are in South African Rand and include VAT, but do not include delivery charge. The actual delivery costs will be shown in an order during checkout and invoiced in addition to the price of the products. PRESTIGIOPLAZA.CO.ZA reserves the right to modify the prices at our discretion for any products before you place and complete your order.
Special price and various discounts (like Promo Price, Bundle Discounts, SALE) may be applicable from time to time for sales prices and deliveries. The information about such programs is available on www.prestigioplaza.co.za instantly.
All prices on this web site and any discounts are applicable to online and offline purchases made either through this website or offline-shop.

PAYMENT METHODS

PRESTIGIOPLAZA.CO.ZA offers the following methods of payment:

  1. Payment authorization of credit cards through JCC secure gateway. All major credit cards are accepted.
  2. Payment upon receipt: You can pay for the order upon receipt in our showroom. To do this, place an order on the website and select the delivery method - Pickup. In this case, the cash payment method will be available to you.
  3. Bank transfer (EFT): You can use your Web Banking service and transfer the amount of your order to our account. Please, contact our manager by phone or email to recieve the credentials for transfer.

WARRANTY AND AFTER-SALES SERVICE PROCEDURES

Our offline shop service specialists provide post-sale service procedure for warranty cases. The majority of the products have a warranty offered directly by the respective manufacturers.
Legal guarantees
Independently of the manufacturer’s warranty provided with products, all products offered to you come with a legal guarantee concerning product conformity and latent defects, as outlined in the consumer protection legislation applicable in the country of delivery of your product.

RETURNS

Cancelation right
Our customers could cancel their orders and return the goods at any time within 14 calendar days after the goods were delivered.
You cannot cancel the order if the goods you have ordered are:

  1. newspapers or magazines, or
  2. if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you, or
  3. any perishables goods or goods that by reason of their nature cannot be returned.

If you are not satisfied with your product and wish to return it, you must inform PRESTIGIOPLAZA.CO.ZA in visiting one of our shops during this 14 days period. Or you can send notification by email general@prestigioplaza.co.za listed on "Contact us" section of the website.
If you cancel the order, you will be under an obligation to return the received goods and pay for the cost of doing so. Any payments, postage charges for returning the goods are not refundable.
During cancelation you have to take reasonable care of the product. The goods, original package, instructions, warranty ticket and other packaging arrangement have to be undamaged and returned with the product.
Once you have notified us that you are cancelling your order and returning the goods, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
Goods Faulty on Arrival
If your item is faulty on receipt (Dead On Arrival - DAO) then please email us prior to returning it using one of our contact email addresses. If the fault is a result of production we will be happy to have the item returned.
DOA goods are covered for up to 28 days from the date of receipt of the product. Beyond this term you should apply to the manufacturer of the product if the manufacturer’s warranty is available, or refer to legal guarantee provided according to consumer protection legislation.
Goods Damaged during delivery
If your item arrives damaged, you are required to contact us immediately with details of the damage. You must retain the envelope and any packaging in order for a claim to be made to the courier for damaging your item in transit. Without all packaging material, you will not be entitled to a damaged goods exchange.
Damaged goods must be reported within 7 days from the date of delivery.
Mixed Goods
If you have been sent the wrong item, please contact us as soon as possible to arrange for the unit to be exchanged prior to your returning the item. We will also refund in money, credit note, or in goods (at our discretion) the cost of shipping.
Mixed goods must be reported within 7 days from the date of delivery.

LIABILITY

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing of the problem within the time limits specified above.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.
Save as precluded by law, PRESTIGIOPLAZA.CO.ZA will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

EVENTS BEYOND OUR CONTROL

PRESTIGIOPLAZA.CO.ZA shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

ACCOUNTS, PASSWORDS AND SECURITY

Certain features or services offered on or through the e-Shop may require you to open an account (including setting up an ID and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by us or any other user of or visitor to the site due to someone else using your ID, password or account as a result of your failing to keep your account information secure and confidential.
You may not use anyone else’s ID, password or account at any time without the express permission and consent of the holder of that ID, password or account. We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

PRIVACY

You acknowledge and agree to be bound by the terms of our privacy policy. Additionally, by using this site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to PRESTIGIOPLAZA.CO.ZA may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

GOVERNING LAW

These terms and conditions, and all transactions relating to this website and all non-contractual obligations arising from any transaction carried out on this website are governed by South Africa law and are subject to the non-exclusive jurisdiction of the South Africa courts.

ENTIRE AGREEMENT

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
These terms and conditions only cover this website. Any other websites to which you link from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites which are not under our control.

AMENDMENTS

We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of the PRESTIGIOPLAZA.CO.ZA site and our services (e-Shop, MultiStore, e-book store, etc.). Any changes will be notified to you via a suitable announcement on this site. The changes will apply to the use of the PRESTIGIOPLAZA.CO.ZA Site after we have given notice. If you do not wish to accept the new terms and conditions, you should not continue to use this site. If you continue to use this site after the date on which the change comes into effect, your use of the site indicates your agreement to be bound by the new terms and conditions.
